As a result of a new disclosure requirement by the Iowa
Real Estate Commission, Black Hawk County Abstract &
Title will be providing this information to Waterloo-Cedar
Falls Board of Realtors members and others, to enable
them to more easily determine and provide restrictive
covenants that may affect a property.
Directions:
- You will need to determine the proper name of the
subdivision/addition that you are interested in and
which can be accomplished in variety of manners. You
can obtain the named subdivision/addition from a deed,
tax receipt or from the Black Hawk County website at:
http://www.co.black-hawk.ia.us . Once you have the proper
name of the subdivision/addition you will need to examine
the list of the subdivisions/additions shown at the
link at the bottom of this page.
- Examine the list and if the filing date is more than
21 years from the date listed at the bottom of the list,
the restriction covenants (if any) contained within
the plat will not be shown on an abstract. If the filing
date is less than 21 years from the date listed at the
bottom of the list, you may request a copy of the restrictive
covenants outlined in the next step.
- Forward a request for the plat restrictive covenants
to the following email address: order@blackhawkabstract.com
in the following format: (example) request plat restrictive
covenants for Briarwood Hills 4th CF, or via fax request
with the same information to: 319-291-3929. We will
make every attempt to respond to your requests as promptly
as possible with the email procedure the more expedient
method.
We will then email or fax you the plat restrictive covenants.
We reserve the option to provide the information to
you in the following descending order:
- (A) abstracted version that appears on abstracts
- (B) scanned images of the document within our
database
- or (C) copy of the document from our microfilm.
On the following page is a list of platted subdivision,
condominiums and minor plats that have been filed for
record in the Recorder’s office of Black Hawk County,
Iowa. The list is password protected and can only be accessed
by those that have been provided the password by Black
Hawk County Abstract & Title. This list will be updated
on a regular basis and when updated a new password will
be utilized to access the list. To receive the new password
when the list is updated you will need to send an email
to the following address with “list password”
in the subject line: tschmitt@blackhawkabstract.com.
Only those restrictive covenants filed within the past
21 years will be shown on an abstract by Black Hawk County
Abstract & Title, unless the restrictive covenants
have been renewed by a claim as provided for in the Code
of Iowa.
